[§1] PRIVACY POLICY

§1.1 — DATA CONTROLLER

RapidCloudHarbor, ul. Marszałkowska 84, 00-514 Warszawa, Polska ("Controller", "we") is the entity responsible for processing personal data collected through rapidcloudharbor.com. Inquiries regarding this policy may be directed to [email protected].

§1.2 — CATEGORIES OF DATA PROCESSED

We process: (a) identity and contact data (full name, work email, telephone number, company name) submitted through the intake form; (b) project scope data voluntarily included in transmissions; (c) technical data such as IP address, browser user-agent, and page timestamps collected automatically for security and diagnostics. We do not process special-category data under Article 9 GDPR.

§1.3 — LEGAL BASES (GDPR ART. 6)

Processing rests on: Art. 6(1)(b) — performance of a contract or pre-contractual steps at your request; Art. 6(1)(f) — legitimate interests in securing the platform, preventing abuse, and responding to business inquiries; Art. 6(1)(c) — legal obligations for tax and accounting retention under Polish law; Art. 6(1)(a) — consent for non-essential cookies, revocable at any time.

§1.4 — PURPOSES AND RETENTION

Contact data is used solely to respond to project briefs, deliver contracted services, and issue invoices. Briefs that do not convert to an engagement are deleted within 12 months. Contract and invoice records are retained for the statutory 5-year bookkeeping period. Server logs are rotated after 90 days.

§1.5 — RECIPIENTS AND TRANSFERS

Data is shared only with processors under written agreements: our hosting provider (EU data residency), Stripe Payments Europe Ltd. for settlement, and transactional email infrastructure. We do not sell or rent personal data. Any transfer outside the EEA relies on Standard Contractual Clauses (Commission Decision 2021/914).

§1.6 — YOUR RIGHTS

Under GDPR you may request access, rectification, erasure, restriction, portability, and object to processing. Requests are resolved within 30 days via [email protected]. You may lodge a complaint with the President of the Urząd Ochrony Danych Osobowych (UODO), Warsaw.

[§2] TERMS OF SERVICE

§2.1 — SCOPE OF SERVICES

RapidCloudHarbor provides software engineering services for multi-tenant SaaS platforms, subscription billing integrations, elastic backend infrastructure, and related technical consulting. Each engagement is governed by a written proposal ("Scope Document") specifying deliverables, fixed price, and turnaround window. In case of conflict between these Terms and a Scope Document, the Scope Document prevails for that engagement.

§2.2 — ENGAGEMENT LIFECYCLE

An engagement commences upon (a) written acceptance of the Scope Document and (b) receipt of the required deposit or full payment via the payment link. Delivery windows begin on the first business day after funds clear. Client response latency of more than five business days to review requests may extend the delivery window day-for-day.

§2.3 — FEES AND PAYMENT

Prices are fixed in the Scope Document, denominated in USD, and exclusive of VAT where applicable. Invoices are due within 14 calendar days. Late payments accrue statutory interest under Polish Civil Code Art. 481. We may suspend work after written notice if an invoice is more than 10 days overdue.

§2.4 — INTELLECTUAL PROPERTY

Upon full payment, all exclusive rights to custom deliverables created under the engagement transfer to the Client. RapidCloudHarbor retains rights to pre-existing tools, libraries, and know-how; where such components are embedded, we grant the Client a perpetual, non-exclusive, royalty-free license for their use within the deliverables. Third-party open-source components remain under their respective licenses.

§2.5 — CLIENT OBLIGATIONS

The Client warrants that materials, credentials, and content supplied for the engagement are lawful and non-infringing, and will designate a single point of contact empowered to make acceptance decisions. The Client is responsible for the security of its own production accounts and API keys at all times.

§2.6 — WARRANTIES AND LIABILITY

We warrant that services are performed with professional diligence and that deliverables will materially conform to the Scope Document for 30 days after acceptance; defect fixes within this window are provided free of charge. To the maximum extent permitted by law, aggregate liability is limited to the total fees paid for the affected engagement. We are not liable for indirect or consequential damages, including lost profits or data beyond direct restoration costs.

§2.7 — TERMINATION

Either party may terminate an engagement for material breach with 14 days written cure notice. Upon termination, the Client pays for all work performed up to the termination date. Provisions on IP, confidentiality, and liability survive termination.

§2.8 — GOVERNING LAW

These Terms are governed by the laws of Poland. Disputes fall under the exclusive jurisdiction of the courts of Warsaw, without prejudice to mandatory consumer protections. The parties will attempt good-faith resolution before litigation.

[§3] COOKIE POLICY

§3.1 — WHAT COOKIES ARE

Cookies are small text files placed on your device by this site. Local storage mechanisms perform a similar function in your browser. This policy covers both.

§3.2 — CATEGORIES IN USE

Strictly necessary (no consent required): session integrity and security tokens required for the site to function. Preference storage: the key cookie_accepted in your browser's localStorage records your acceptance of this banner so it does not reappear on every visit; it stores no personal identifiers and never leaves your device. Analytics: if enabled, aggregated, IP-truncated page-view statistics; currently we rely only on infrastructure-level logs.

§3.3 — THIRD-PARTY COOKIES

Embedded services — such as the Google Maps iframe on our contact page — may set cookies under Google's own policies when loaded. Payment interactions occur on Stripe's domain under Stripe's cookie policy. We do not control these cookies.

§3.4 — MANAGING COOKIES

You may clear stored cookies and local storage at any time via your browser settings; doing so will cause the consent banner to reappear on your next visit. Blocking strictly necessary cookies may degrade site functionality. Questions: [email protected].

[§4] REFUND POLICY

§4.1 — CANCELLATION WINDOW

If you cancel a fixed-price engagement within 48 hours of payment and before any work has commenced, you receive a full refund. After work has commenced, the deposit is non-refundable; any prepaid balance beyond work performed is returned within 14 business days.

§4.2 — DEFECT REMEDIATION

Deliverables that materially fail to meet the Scope Document are remedied at no cost within the 30-day acceptance warranty described in §2.6. If we cannot remediate a material defect after two reasonable attempts, you may terminate the engagement and receive a pro-rata refund for the undelivered portion.

§4.3 — RETAINERS

Monthly SRE and maintenance retainers may be cancelled at any time effective at the end of the current billing month. Unused prepaid hours from a prior month do not roll over unless the Scope Document states otherwise. No partial-month refunds are issued after the month has started.

§4.4 — NON-REFUNDABLE ITEMS

Domain registrations, third-party license fees, cloud infrastructure costs already incurred, and completed discovery or audit phases marked as non-refundable in the Scope Document are not eligible for refunds.

§4.5 — REFUND EXECUTION

Refund requests are sent to [email protected] with the invoice reference. Approved refunds are returned to the original payment method within 14 business days. Statutory consumer rights under Polish law remain unaffected.
